Welcome to Picotap. By downloading, installing, or using our pixel art editor application ("App"), you agree to be bound by these Terms of Use ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using Picotap, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Picotap is a pixel art creation application designed for mobile devices. The App provides:

• Pixel art drawing tools with touch-optimized controls
• Color palettes and brush patterns
• Export functionality to save your artwork
• Backup and restore features

3. No Account Required

Picotap does not require you to create an account. You can use all features of the App without providing any personal information. All your artwork and settings are stored locally on your device.

4. Your Content and Ownership

4.1 Ownership of Your Artwork

You retain full ownership of all pixel art and content you create using Picotap. We do not claim any rights to your artwork. You are free to use, share, modify, sell, or commercialize your creations in any way you choose.

4.2 Local Storage

All artwork is stored locally on your device. We do not upload, access, or store your artwork on our servers. You are responsible for backing up your work using the App's backup feature.

4.3 Responsibility for Content

You are solely responsible for any content you create and share using the App. When sharing your artwork, please respect applicable laws and the rights of others.

5. Intellectual Property

The Picotap name, logo, and the App itself (excluding your artwork) are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute the App or its code without our permission.

6. Advertising

Picotap displays advertisements:

• Banner Ads: May be displayed within the App.
• Rewarded Ads: You may optionally watch video advertisements to unlock certain features such as high-resolution export, extended canvas sizes, and additional color palettes.

Advertisements are provided through Google AdMob. By using the App, you agree to the display of advertisements as described.

7. Acceptable Use

While using Picotap, you agree not to:

• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App for any illegal purpose
• Interfere with or disrupt the App's functionality
• Attempt to bypass any advertising mechanisms

8. Data and Backup

8.1 Local Data

All your data is stored locally on your device. If you uninstall the App, change devices, or experience device failure, your data may be lost unless you have created a backup.

8.2 Backup Feature

We provide a backup feature that allows you to export your data. We strongly recommend regularly backing up your work. We are not responsible for data loss due to device failure, App uninstallation, or failure to create backups.

9. Availability and Updates

We strive to keep Picotap available and functional, but we do not guarantee uninterrupted access. We may:

• Update the App with new features, bug fixes, or changes
• Modify or discontinue features at any time
• Require updates for continued use
• Discontinue the App entirely without prior notice

10. Platform-Specific Terms

Picotap is available on multiple platforms including iOS, Android, macOS, and Web. Your use of the App is also subject to the terms of the platform from which you downloaded it (such as the Apple App Store or Google Play Store).

11. Disclaimer of Warranties

Picotap is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App will meet your specific requirements
• Your data will be preserved indefinitely

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, artwork, or profits, arising from your use of the App.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.
